Service Agreement & Terms and Conditions

2. Estimates and Pricing
All estimates are based on:

Visual inspection (if performed)

Current material and labor rates
Final pricing may change if:

Additional issues are discovered

Project scope changes

Hidden damage is found

Additional parts or labor are required
The Customer will be notified before additional charges are incurred whenever reasonably possible.
3. Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing.

We may require deposits for certain services.

We accept approved payment methods as listed on our Site or invoice.

Late payments may result in additional fees.
Failure to pay may result in collection efforts or legal action.
4. Cancellations and Rescheduling

6. Permits and Compliance
The Customer is responsible for obtaining any permits required by local law unless otherwise agreed in writing.
The Whit S LLC does not provide licensed structural engineering, architectural, or specialized regulated services unless explicitly stated.
7. Limited Warranty

Our total liability for any claim shall not exceed the amount paid for the specific service provided.
This limitation applies regardless of the legal theory asserted.
10. Property Damage
While we take reasonable care during service:

The Company is not responsible for pre-existing damage.

Minor cosmetic imperfections may occur during installations (e.g., small wall marks).

The Customer must notify us of any damage claim within 48 hours of service completion.
11. Right to Refuse Service
We reserve the right to refuse or terminate service if:

Working conditions are unsafe

The Customer behaves in a threatening or inappropriate manner

The requested work violates local laws or regulations
12. Independent Contractor Status
The Whit S LLC operates as an independent contractor. Nothing in this Agreement creates a partnership, joint venture, or employment relationship between the Company and the Customer.
13. Force Majeure
We are not liable for delays or failure to perform due to events beyond our reasonable control, including:

Weather conditions

Natural disasters

Supply shortages

Government restrictions
14. Website Terms
Use of our website is also governed by our Privacy Policy and Disclaimer, which are incorporated by reference into this Agreement.
15. Governing Law
This Agreement shall be governed by the laws of the State of WI, without regard to conflict of law principles.
Any disputes shall be resolved in the appropriate courts located within that state.
16. Entire Agreement
This Agreement constitutes the entire understanding between the parties regarding services provided and supersedes all prior agreements or understandings.
